Position

Daniele Caneva is the EY IP Europe West Leader and Head of the Intellectual Property team at EY TAX & LAW ITALY.

His practice focuses on advising national and international clients on a wide range of Intellectual Property matters in addition to assisting clients, from a strategic point of view, with portfolio management. He also has a wealth of experience working with clients on contentious matters in order to protect and defend their intellectual assets.  This also includes counsel on labelling and the use of the “Made in Italy” trademark.

Clients include major domestic and international luxury, fashion, pharmaceutical, automotive, media, entertainment, publishing and software companies.

Of note is Daniele’s initiative to better protect clients’ intellectual assets – both tangible and intangible – through the valorization and defense of know-how within the context of ‘Patent Box’ and a pioneering ‘Master Book’.  You can read more about these initiatives spearheaded by Daniele below.

Also of note is his extensive experience assisting clients with industrial and intellectual property contracts – including the negotiation of complex agreements for the exploitation of patents and know-how.

Career

Daniele Caneva is the Founder of EY‘s Intellectual Property law department – which was established when he joined the firm in April 2019 with his whole team from CREA Avvocati Associati where he was a founding member.

Personal

Daniele has pioneered new tools for clients to better manage their intellectual assets:

PATENT BOX

An Italian law initially introduced in 2015 and subsequently modified allows to companies to get tax benefits linked to costs born in activities of research and development destined to launch on the market new software, patents and designs.

However very few clients know how to maximize the benefit of this regulation.

Hence Daniele developed an innovative packaged service for clients, working closely together with the EY Tax team, to help optimize all the costs borne by companies through a full-scale re-evaluation of the intangible assets.

MASTER BOOK

Daniele has pioneered a procedure for the certification of know-how through an in-depth investigation which includes conducting interviews with the client’s key R&D staff, legal due diligence and quality controls.  All documented and undocumented know-how can truly be uncovered and the correct protections applied.

The output of this work is a Master Book, a guide of all the owned know-how,  certifying features in the production process as well as confidentiality measures of protection.
