Position

Janet is a partner in the litigation department at Fladgate.

She specialises in commercial litigation with an emphasis on disputes concerning real estate.

Janet’s expertise in relation to commercial civil litigation encompasses joint venture and property partnership disputes, contractual disputes, including those for the sale and purchase or letting of real property, commercial arbitrations (including international arbitrations) and disputes as to ownership of or interests in real property, including Land Registry adjudications.

She also acts on professional negligence claims, in particular against solicitors or surveyors, construction/variation/enforcement of restrictive covenants and mediation and other forms of alternative dispute resolution

In relation to commercial landlord and tenant matters, Janet advises on construction of leases (particularly rent review clauses), rent review arbitrations and references to independent experts, making/defending claims on repairing obligations, rent recovery from present and previous tenants, the impact of Landlord/Tenant insolvency including disclaimers and vesting orders, acting for Law of Property Act Receivers, refusal of consent for alterations/assignment, seeking and opposing business lease renewals, upholding/defeating tenants’ break clauses and taking/resisting actions for forfeiture/possession and/or damages, including site assembly for redevelopment.

Janet acts for a wide range of clients, from large scale investors to individuals with a “one-off” claim. Janet has considerable experience of resolving disputes through arbitration, mediation and other alternative methods as well as litigation.

She is a member of the Property Litigation Association and the Association of Women in Property, and her expertise has been recognised by Legal 500 and Chambers UK.

Janet read law at Bristol University and qualified as a solicitor in 1984. She has been a partner in the firm since 1989.

It also defends claims for clients such as Deloitte, the Medical Defence Union and Zurich. Team head Simon Brew acts for claimants and defendants in claims involving accountants, solicitors and construction professionals, and represented a Hong Kong-based company in a $1m claim against its former solicitors for professional negligence, breach of trust, breach of fiduciary duty and breach of contract. Litigation head Simon Ekins, Janet Keeley, Sophia Purkis, Jonathan Hibberts and Digby Hebbard are also key members of the department.

Fellas is representing Point West GR Limited in a high-value service charge dispute at a building containing 399 residential units. Another highlight saw Alison Mould acting for the Trustees of the first Lord Brocket in relation to disrepair issues and various breaches of a tenant covenant at a Grade 1 listed estate. Tim Foley's arrival from Clyde & Co LLP has bolstered the group which also consists of Janet Keeley who is ‘analytical, thorough and very robust’ and Jonathan Hibberts who ‘always goes the extra mile to deliver for his clients’.
