Complexity characterises a system or a model whose components interact in multiple ways, leading to non-linear behaviour. One of the problems in addressing complexity issues is the large number of variances in a given system. Examples of such issues are the topics that will be discussed in our GC Summit Brazil 2022: cyber-security, cryptocurrency and the ESG regulatory uptake. On the rise across the globe, these are phenomena that demand more attention. Cyber-security threats occur on a day-to-day basis and can cause high damage to companies’ assets and businesses’ activities. Cryptocurrency represents another unpredictable environment that can bring instability and disruptive effects. Finally, the application of ESG is difficult to measure and compare across companies and there is still a lack of clarity regarding its degree of compliance. During this GC Summit Brazil 2022, our brilliant speakers will explore the variables associated with these complex areas, their challenges and benefits, and they will provide practical solutions to prevent and address growing issues. 2.10pm Cybersecurity incidents: key issues and response strategies
Cybersecurity has become a high-profile global issue. Cyber-threats occur on a day-to-day basis and their frequency has dramatically increased. With a specific focus on Brazil, this panel aims at i) understanding the impact that cybersecurity breaches can have on businesses and institutions and the damages they can cause to companies’ assets, ii) prevention of cyber-attacks, iii) actionable advice in case of security incidents: how to mitigate risks, iv) how cyberinsurance can play a key role in safeguarding the continuity of businesses’ activities.

3.10pm Into the unknown: thinking about the future of crypto
Despite significant hype and promise about its future, crypto has faced significant headwinds this year, including liquidity issues, high-profile bankruptcies, the instability of stablecoin, inflation and interest rate volatility, widespread claims of fraud from retail investors, misappropriation and theft by rogue states and bad actors, and an unpredictable and potentially hostile regulatory climate.  The panel will evaluate these challenges and consider what the future is likely to hold for crypto.  We will discuss the current regulatory environment, as well as what is under consideration in the United States, Europe and Latin America.  Debate will address the role of cryptocurrency in the context of fiat currencies and managing the disruptive effects it presents.

4.20pm ESG: A complex network approach
Nowadays, Environmental, Social and Governance (ESG) are the three key generally agreed-upon factors that determine the positive impact of a business. They represent the nodes of a weighted complex network whose weights grow when businesses do not address them properly. Despite being a pressing concern, there is still a lack of clarity regarding the necessary degree of compliance with these principles. This panel aims to investigate how to empirically implement these criteria, recommended for all in-house counsel and business-owners wishing to learn more about satisfying ESG criteria and disclosure of ESG goals.

Fábio Luiz Barboza Pereira, partner, Veirano

Fabio Pereira is a partner in the intellectual property practice and head of the information technology, and data protection and privacy practices at Veirano Advogados in Sao Paulo. He holds an LLB from PUC-Rio, a post-graduate degree in civil law from ESA-RJ and an LLM in intellectual property from Queen Mary and Westfield College, University of London. He is the co-coordinator for digital law and data protection and is a member of the board of directors of the Brazilian Intellectual Property Association (ABPI). He is also the chair of the privacy committee at the ItechLaw Association. Fábio has authored several articles and publications in the fields of IP, IT, entertainment and privacy and frequently lectures at national and international events. He has worked as in-house counsel for TV Globo and for the Roberto Marinho Foundation, and as legal affairs and intellectual property manager for the University College London Hospitals in England. Fábio is recognised by Chambers & Partners as an Expert Based Abroad for the UK in IP, by The Legal 500, and by Who’s Who Legal as an expert in intellectual property, information technology and privacy.

Filipe Scherer Oliveira, partner, Veirano

Filipe Scherer Oliveira is a partner in the disputes team of Veirano Advogados and co-leads the firm’s team dedicated to responding to cybersecurity incidents. Filipe has strong experience in defending clients in public civil actions and sensitive class actions, in domestic and international arbitration related to infrastructure projects and commercial and corporate disputes, and in actions related to cybersecurity incidents. Filipe holds a law degree from UFRGS and a master’s degree (LLM) from Harvard Law School.

Marta Helena Schuh, director, Marsh McLennan

Marta Schuh is director of cyber risk at Marsh Brasil. She has a bachelor of business from the University of Arts London, a degree in finance from the Chartered Institute for Securities & Investments UK and is certified in the economics of cybersecurity by the Delft University of Technology.

Marta specialised in digital law from Insper, cybersecurity for insurance from UCLA, cyber attacks from NYU Tandon School of Engineering, and digital disruption: digital transformation strategies from Cambridge University. She is an instructor in cyber security on the postgraduate course in digital law at Universidade Paulista de Direito. Marta was recognised by Womcy (Latam Women in Cybersecurity) as the top cyber leader in Latin America 2022.

Ross Kaufman, partner, Greenberg Traurig

Ross Kaufman is a member of global law firm Greenberg Traurig, based in its New York office. He has been an active participant in the Brazilian market for more than 40 years. He is a graduate of Yale University and the University of Chicago Law School, and was a Fulbright Scholar at the University of Sao Paulo.

Anne Chang, director, Berkeley Institute of Technology Global Society

A lawyer specialising in M&A and investments, she graduated from Largo San Francisco – USP with an LLM from the University of California – Berkeley. She is director of the Berkeley Global Society’s Institute of Technology and co-author of books and articles, including the whitepaper Blockchain and Health IT: Algorithms, Privacy and Data (MIT Experimental Learning, 2016), pioneering blockchain and healthcare.

Courtnay Guimarães, director of strategy practice, chief scientist of meta economy, Avanade Brasil

Courtnay Guimaraes has been in the technology market for 38 years, with experience in several industries, focusing since 1995 on the financial market in general.
A computer scientist, cryptographer, and economist with specialisation in capital markets and trading, PhD candidate in CBDCs with focus on privacy and quantum consensus.

Reinaldo Rabelo, CEO, Mercado Bitcoin

Reinaldo Rabelo is CEO of Mercado Bitcoin, where he joined in 2017, and led the project that gave rise toMB|Digital Assets, a business unit for blockchain and tokenisation of real assets. Before that, he was an executive director for almost ten years at [B]³ (Cetip), responsible for the risk, compliance and legal areas, where he was one of the leaders in the creation of its innovation programme (Foresee). He is a lawyer by training and an investor in about 25 fintechs, such as Neon, ASAAS, Monkey Exchange, Fisher Venture Builder, Ali Crédito, Monetus.

Eloy Rizzo, partner, Demarest

Partner in Demarest’s compliance and investigations and ESG practice areas, Eloy Rizzo holds a master’s degree (LLM) in competition law and international arbitration from King’s College London (England) and a postgraduate degree in Civil Procedural Law from PUC-SP. Eloy has completed the competent boards global certificate and designation programme and was awarded the ESG competent boards certification and designation (GCB.D). He is a professor of LEC – legal, ethics and compliance – at the faculty of law of PUC-SP for the postgraduate compliance course and lectures in the compliance anti-corruption program of FIA – Fundação Instituto Administração Business School. Eloy is also recognised by leading legal publications such as Chambers & Partners, Who’s Who Legal and Leaders League. In 2019, 2020 and 2021 Eloy has been recognised by peers and clients as one of the ‘Elite 10’ Brazilian compliance and investigations lawyers.

Fernanda Stefanelo, partner, Demarest

Partner in the environmental and ESG areas of Demarest Advogados, Fernanda holds a bachelor of laws degree from Faculdades Integradas Toledo, as well as specialisations in environmental law from Pontifícia Universidade Católica de São Paulo (PUC/SP) and in environmental management and business in the energy sector from Universidade de São Paulo (USP). She also holds a master’s degree in environmental law from Universidade Católica de Santos (UNISANTOS). Fernanda is a member of the legal committee of the Brazilian Association of Environmental Consulting and Engineering Companies (AESAS), – the Latin American Climate Lawyers Initiative for Mobilizing Action (LACLIMA), the Group for Advanced Studies in Agrarian Law of the Arcadas Foundation at USP, and the ESG Commission of the Brazilian Institute of Business Law (IBRADEMP).

Marco Antonio Fujihara, director, RADCE

Mr Fujihara has more than 40 years of experience in the forestry sector as an agronomist. He holds a specialisation from Harvard in economics focused in agribusiness, forestry companies, strategy and policies, and climate change. He is the director of RADCE, a consulting company focused on the management of green and sustainable investments and also acts on a number of boards for companies and entities of the third sector. Mr Fujihara also develops digital platforms and sustainable financing with the help of credit instruments and venture capital for Ecofix Securities and for global environmental services platform The Nature Conservancy (TNC). He is on the advisory board of the Carbon Disclosure Project LATAM and the Local Governments for Sustainability network and has acted in the Intergovernmental Panel on Climate Change as a reviewer for Working Group II (WG2), in addition to acting as an advisor to the Climate Investment Funds. Mr Fujihara also served as co-ordinator of Forest Products for Mercosul, as Superintendent of the Brazilian Association of Silviculture, as Coordinator of Natural Resources at the Brazilian National Pulp and Paper Association (Bracelpa), and as Director of Renewable Natural Resources at IBAMA in Brasilia.

Patricia Cordeiro Nader, head of impact and investor relations, Good Karma Ventures

Experienced investment, M&A and business development professional with a demonstrated history of working in an array of industries and sectors in Brazil and in other countries in South America, holding management and leadership positions. Strong professional with a Master of Business Administration (MBA) from INSEAD. Patricia leads impact and investor relations at Good Karma Ventures, a leading growth-stage firm investing in mission-driven companies in Brazil. Patricia has extensive previous experience in mergers and acquisitions, business development and strategic planning within different multinational companies in the agri, biotechnology and food and beverage sectors and is also an experienced investment professional with knowhow in (1) conducting mergers and acquisitions processes in several sectors; (2) developing strategies; and (3) identifying new business opportunities.

Daniel Crespo, managing director, Lineal

Daniel Crespo is the managing director of Lineal in Brazil. He has vast experience in compliance, cybersecurity, and data privacy and has assisted multi clients, Brazilian and multinational companies on complex internal investigations and cybersecurity issues, including cybersecurity incident responses. In addition, Daniel has vast experience in eDiscovery, electronic data collection at all stages of research, and Early Data Assessment (EDA) interviews on cross-border investigations. Daniel Crespo earned his law degree (LLB) from the Pontifical Catholic University of São Paulo (PUC-SP) and has a specialization degree in compliance from the Fundação Getúlio Vargas (FGV-SP). Daniel also has a specialization degree in Corporate Criminal law from Instituto de Direito Público (IDP). He is admitted to Brazil Bar Association.

Dante Araújo, legal director, IBM Latin America

Dante has over 16 years of experience in the IT industry and is currently the legal director for IBM Latin America, overseeing the legal support in the region. Before taking his current role, he was the head of legal and DPO for IBM Brazil. He holds a JD from Mackenzie University, a postgraduate degree in business law from Fundação Getúlio Vargas and an executive MBA from Fundação Dom Cabral.
