摘 要：各国和地区为功能性外观设计包括功能性外观设计特征的判断创设了不同的标准，但是其出发点皆在于引导理论，以在外观设计与发明专利之间划出相对清晰的界限，特别是防止借用外观设计在事实上提供发明专利保护，进而侵入公有领域或者损害竞争。然而，若仔细分析功能性原则的实践及其效果，就会发现通过外观设计为功能性提供一定程度的保护并不会损害引导理论的法理基础。若以外观为外观设计权的保护对象，则有利于提高外观设计确权、侵权判断的客观性。建立于功能性与装饰性区分基础之上的功能性原则也失去了其存在的意义。
