This analysis examines 7,059 rejection review cases from 2025 to explore how China's National Intellectual Property Administration evaluates similarity in combined marks versus pure text or graphic trademarks, offering strategic insights for trademark applications and similarity arguments.
鉴于实质审查阶段对图文组合商标中的图形与文字分开审查，相较于纯文字或纯图形商标，图文组合商标可能面临更多在先权利障碍。但当存在较难克服的纯图形在先障碍时，以图文组合的形式提交申请往往有助于提高成功率。文章基于2025年驳回复审全部初审的7059件案例，从图文组合商标审查逻辑、近似判断标准入手，探究当前国知局对图文组合商标引证纯文字商标被驳回、图文组合商标引证纯图形商标被驳回、图文组合商标引证图文组合商标被驳回的审查情况，以期为图文组合商标争辩不近似及商标申请提供思路参考。
