Position

Tom Fothergill is a corporate, funds and regulatory lawyer in Walkers’ Jersey Investment Funds & Corporate Group.

Tom specialises in M&A and the solvent restructuring of regulated financial services business.  Prior to joining Walkers, Tom was a senior financial services policy adviser to the Chief Minister of Jersey in which role he focussed on financial crime and AML/CFT, beneficial ownership and economic substance, bank recovery and resolution, deposit compensation and fintech.  Tom regularly advises businesses on Jersey’s economic substance requirements and other regulatory obligations.

Prior to working for the Government of Jersey, Tom practised in the Corporate and Finance Group of another leading offshore law firm.  During that time Tom acted on six banking business transfer schemes as part of restructurings of many of the largest UK and offshore banking groups, as well as numerous insurance business transfer schemes and other banking and investment business restructurings.

Tom is a member of the Jersey Bank Depositors Compensation Board and Jersey’s Digital Assets Working Group, and continues to support the Government of Jersey on the development of legislation and regulation in financial services and digital assets.

Career

Prior to joining Walkers, Tom spent three years working for the Government of Jersey as Lead Policy Adviser, Financial Services & Digital Economy then Lead Policy Adviser, Financial Crime. In these roles Tom represented the Island to Moneyval, FATF, the OECD, EU, and other governments and was closely involved with policy and legislation development particularly in relation to AML/CFT, beneficial ownership, economic substance, fintech and bank resolution.

Before joining Government, Tom worked for another law firm in Jersey where he specialised in restructuring offshore banking and insurance groups. He qualified as an English Solicitor in the London office of Irwin Mitchell.

Before training as a lawyer, Tom served on operations as an officer in the British Army where he led a portfolio of post-conflict reconstruction and stabilisation projects, and was the founder and director of a popular London restaurant.
