Career

Andrew Willins is a partner and Group Head of the Dispute Resolution department in the British Virgin Islands. He has over 15 years experience as an advocate, drawn from his time at the Chancery Bar in London and in the British Virgin Islands. He has particular experience in insolvency litigation, shareholders´ disputes and in complex commercial litigation, including professional negligence and cross-border fraud and asset tracing claims. He appears regularly in the Commercial Division, before the High Court of the Eastern Caribbean Supreme Court, and has appeared on a number of occasions before the Court of Appeal, in both England and in the BVI, as sole advocate.

Andrew is a member of the Chancery Bar Association, the Property Bar Association and INSOL International. He served as 2nd Vice President of the BVI Bar Association for two terms, between 2011 and 2013.

Appleby's practice is best known for shareholder disputes and insolvency work; the team has also experienced an increase in fraud and asset-tracing work, particularly from Russia and the former CIS states, and is increasingly active in trusts litigation. The team acted for Stockman Interhold in long-running litigation involving the ownership of shares in a Ukrainian shopping mall; it also defended the eighth defendant against a substantial fraud claim that was brought by former employer Eurochem, alleging that he received bribes and channelled them through a network of BVI companies. Andrew Willins  is highly rated; Olwyn Barry, who splits her time between the BVI and Jersey offices, and Justin Davis are experienced senior associates.

Frequently instructed by blue-chip trust institutions, Appleby's BVI private client and trusts practice advises on all aspects of trust law, including the establishment, administration, restructuring and termination of private, charitable, purpose and commercial trusts. The team worked alongside London solicitors and counsel in a complex piece of trusts litigation; this involved securing the dismissal of claims that a deed of appointment by which trust assets appointed to the firm's client should be set aside. The practice's contentious trusts work is headed by Andrew Willins, while non-contentious trusts advice is provided by BVI-admitted trusts practitioners, who practice from Cayman and are led by global practice group head Carlos de Serpa Pimentel.
