Partner

Recognised expert who has acted for many years for major insurers under the Law Society of Scotland Master Policy in investigating and defending claims made against solicitors for alleged breach of contract or negligence. Also acts on behalf of accountants, surveyors (commercial and residential), brokers and other professionals in the defence of claims brought against them and for individuals and corporate clients where Scots law applies in the pursuit of claims against professionals for negligence and breach of contract. A qualified mediator, Derek has experience of representing clients and achieving successful outcomes for them at mediations. Landmark Decision in Case of Identity Fraud announced 5 September 2012 by Inner House of the Court of Session in Edinburgh in relation to cases involving the stolen identity of innocent individuals: Cheshire Mortgage Corporate Limited v Longmuir & Co and Blemain Finance Limited v Balfour & Manson LLP.

Career

Joined Brechin Robb (forerunner to BTO Solicitors LLP) as an apprentice 1978; Mentor for students on the University of Glasgow Legal Diploma course.  Made Partner in 1984.
