Gemma Noble

Career

Gemma practises in all areas of criminal law and has extensive experience of defending in the Magistrates’ Court, Youth Court and the Crown Court. Gemma also prosecutes in the Crown Court. She accepts both private and public instructions and has been instructed in a wide range of criminal offences including violence, sexual offences, drugs, dishonesty, confiscation and road traffic offences.

Additionally, Gemma acts in a range of civil matters including SHPO, DVPO and CBO proceedings.

Gemma joined 3 Temple Gardens in April 2020 following successful completion of her pupillage. Before joining Chambers, Gemma worked at EBR Attridge Solicitors as a paralegal and police station representative. She also volunteered as an Appropriate Adult, and so is experienced with the additional issues that often arise when representing young or vulnerable clients. She is a personable and down to earth advocate and prides her ability to put clients at ease with clear advice and persuasive style of advocacy.

Notable Cases

• R v OB [2020] – OB was a youth convicted of high value handling stolen goods and 4th breach of a CBO and was committed to the Crown Court for sentence. Sentenced to a YRO with ISS.

• R v B [2020] – Committal for sentence for dangerous driving and driving whilst disqualified. Third offence of driving whilst disqualified. B wrote off the vehicle during a police pursuit. SSO without conditions imposed.

• R v C [2020] – C was charged with harassment against two neighbours. Acquitted after trial.

• R v A [2020] – A was committed for sentence for four counts of harassment (fear of violence) committed during the operational period of an SSO imposed for similar offending. Secured another SSO to run concurrently with the current order.

• R v P [2019] – P convicted of stalking (fear of violence). The court determined this was an offence with a starting point of two and a half years. Persuaded the court to sentence outside the guidelines and keep in the Magistrates Court. P received a 12-month community order.

• R v C [2019] – C accused of assaulting a child. The young witness attended court to give evidence. C acquitted after trial.

• R v W [2019] – W convicted of possession of a knife (second strike) who failed to attend his sentencing hearing. Persuaded the court to impose an SSO and no action was taken on the bail act offence.

• R v J [2019] – J pleaded guilty to a s.5(1)(b) Firearms Act offence (possession of a taser within a knuckleduster). Secured a 12 -month community order.
