Specialises in EU law, environmental law, commercial law, international law and arbitration; cases include: Ex p Standley (the application of general principles of EC environmental law); Ex p Yorkshire Water Services Ltd (application of Carltona principles); Ex p Kelly on (authorisation under Radioactive Substances Act 1993 and Articles 6 and 10 ECHR); Ex parte Vetterlein (Article 6(1) ECHR and planning decisions); Barratt’s Homes Ltd v Dwr Cymru Cyfyngedig (connection rights to urban wastewater collection systems); JPMO v The States of Jersey and the Jersey Potato Marketing Board (in the Jersey Royal Court and ECJ on free movement of goods between Jersey and the EC; Lennox v ILCO (ECJ) on free movement of agricultural goods within the EC; Ex p Horwath (ECJ (compatibility of constitutional devolved government arrangements with EU regulations); Uniplex (ECJ) (application of EU fundamental principles of legality and legal certainty in public procurement challenges). Has advised and acted on behalf of the European Commission, the European Bank for Reconstruction and Development, the European Investment Bank, government ministries, privatised utilities, corporations, NGOs and individuals and appeared before international, EU and domestic courts and tribunals on behalf of various public entities, commercial operators, NGOs and individuals.

Career

Called 1984; assistant to the President of the Italian Constitutional Court, Rome and assistant to the Italian Minister for the Co-ordination of European Politics, Rome (1986-89). Publications include: co-editor ‘Rio Principles: A Comparative Study of the Theory and Practice of the Precautionary Principle’ (GLNI 2001); author of UK section on ‘Access to Justice on Environmental Matters and the Role of NGOs’, European Law Publishing; author on the European Court of Justice and Court of First Instance to ‘Manual on International Courts: Practice and Procedure’; author of environmental section ‘Bullen & Leake on Precedents and Pleadings’ (Legal Pleadings Publication 2000 to date); author of environmental chapters in ‘Totty and Moss on Insolvency’ and ‘Lightman and Moss on the Law of Administrators and Receivers of Companies’ contributor to ‘Practitioners Handbook on EC Law’ (Bar Council 1999); co-contributor and editor of ‘EC Legal Systems: Introductory Guide and ‘EFTA Legal Systems: Introductory Guide’; EC editor of ‘Encyclopaedia of Banking Law’; and English editor of ‘The Italian Yearbook of Civil Procedure’.
