Partner and advocate of the Royal Court of Jersey and English barrister. Nigel specialises in trusts and general commercial law. Advisor to international banks, trust companies and financial institutions. He frequently lectures at conferences and provides in-house seminars to institutional clients. Nigel’s practice is mainly involved with transactional work but he also appears before the Royal Court in relation to non-contentious trust and corporate applications. Private client/trust work: advised Volaw trustees on its involvement in substantial UK divorce proceedings involving tax upon trust assets. Halibi v Halibi; Toulouse Trust, on-going trust dispute issuing involving family dispute over rights to benefit from the trust fund following the death of the settlor; advised on the reorganisation of a multi-billion dollar trust. This involved the restructuring of two PTC structures to facilitate their export to Cyprus in connection with Russian tax planning requirements; advised upon the Princess Yachts Channel Islands franchise; advised Philean Trust Company on its non-regulated service offering; minor beneficiaries in connection with a Beddoe application brought by Barclays in connections with substantial litigation over a sales dispute; personal advisor for Hanger 8, a company providing private jets, who are AIM listed and seek to move to Jersey; lead advisor in the sale of a large Jersey insurance company; lead advisor on the sale of a large travel agency based in Jersey; acting for majority shareholder for a company that sold 40% of its stock to the Japanese and involved in further restructuring; lead advisor in the ‘deoffshorisation’ for a Russian business relocating to Cyprus; corporate restructuring of a mining company.

At Voisin Law, Nigel Pearmain handles work for a number of trust companies, including terminations of trusts, issues of intermeddling and cross-border tax – also an area of activity for Ian Strang. Many matters are set against backdrops of various kinds of litigation and potential regulatory challenges. In addition, Clare Nicolle is active specifically in matters concerning Jersey wills, with many matters just as in England involving complex issues of mental capacity – some of her work comes as a court-appointed financial delegate.
