Career

Martin has been practicing law in the ASEAN Region since 1999. As head of DFDL's Banking & Finance Practice Group, he has been counseling a diversified group of foreign investors, including investments funds, international banks and large Asian investors, on their investment in the ASEAN Region. Martin also advised various governmental entities under technical assistance projects (notably for the World Bank, Asian Development Bank and European Union) on various aspects of the development of investment, regulatory and legal frameworks. He heads the DFDL ASEAN Task Force, which examines the legal intricacies of all the ASEAN Agreements and their impact on foreign investors.

Managing director Guillaume Massin advised SCA/Cambodia Airports on concession agreements and land use rights following the extension and renovation works at Phnom Penh, Siem Reap and Sihanoukville airports. Managing partner Martin Desautels and the firm's head of banking and finance, Daniel Wein, acted as local counsel advising China Development Bank on the RMB1bn interbank loan to Canadia Bank. DFDL Legal & Tax's Jérôme Buzenet and Hoang Phong Anh advised Qatar Petroleum International on the sale of its share in the Long Son petrochemicals project to Siam Cement. Anh and Martin Desautels, who are active in projects across the region, advise the Ministry of Industry and Trade on various issues concerning the Nam Dinh energy project. As part of a multinational team, the practice advised B. Grimm Power Company, which has a subsidiary in Vietnam, on its IPO in Thailand. Other mandates concern solar energy.

    On 6/20/2012, the National Assembly voted to adopt the Law on Price (the "LOP") in response to the public demand for an effective legal framework to control price manipulation from dominant enterprises such as gasoline, electricity, etc. The law will take effect from 01/01/2013 and repeal Ordinance No. 40/2002/PL-UBTVQH10 dated 26/4/2002 of the National Assembly Standing Committee (the "Ordinance"), which is conceived as outdated and containing certain provisions contravening the WTO’s regulation. This article describes the main features of the law and provides some insight into its potential impacts on the Vietnamese economy.
