Overview

Workplace investigations are getting riskier, faster—and more complex. Join McCarthy Tétrault’s Kate McNeill Keller, Trevor Lawson, Kevin Lo, and Shane D’Souza for a dynamic fireside discussion on how investigations are evolving, with consideration of AI, digital forensics, social media, and rising litigation, governance, regulatory, and reputational risk.

Drawing on recent mandates and multidisciplinary experience across employment, forensics, litigation, regulatory and governance, the panel will examine when investigations help,— when they create new exposure, and how to set your organization up for success. The discussion will explore where processes break down, what courts, regulators, and boards are scrutinizing most closely, and how tools such as AI and digital surveillance can be used thoughtfully to improve speed, credibility, and defensibility without undermining fairness or privacy. This session goes beyond the basics to address pain points and emerging expectations around transparency, procedural fairness, investigator independence, and strategic escalation.

Attendees will leave with practical, forward looking insights into how leading organizations are navigating today’s workplace challenges — and what to expect as investigations continue to evolve.


Speakers

Kate McNeill-Keller

Kate McNeill-Keller is a partner in the firm’s Labour & Employment Group in Toronto. She represents management in all aspects of labour and employment-related issues including employment standards matters, wrongful dismissal litigation, labour arbitrations, occupational health and safety, human rights litigation and labour and employment issues arising in corporate transactions. She has represented both federally and provincially-regulated employers, in both the private and public sectors, including before the Ontario Superior Court of Justice, the Ontario Labour Relations Board, the Ontario Human Rights Tribunal, the Canadian Human Rights Tribunal, boards of arbitration and in private dispute resolution. The clients that Kate represents carry on business in a wide range of sectors, including government, retail, education, communications, banking and finance, insurance, energy, technology, manufacturing, consumer goods, and pharmaceuticals.

Trevor Lawson

Trevor Lawson is a partner in our Labour & Employment Group in Toronto. His broad practice encompasses all aspects of labour and employment-related litigation, labour relations, corporate transactions, executive compensation and privacy. He has represented employers in proceedings before the Ontario Superior Court of Justice, Court of Appeal for Ontario, Ontario Labour Relations Board, Human Rights Tribunal of Ontario, boards of arbitration, coroner’s inquests and other administrative tribunals. His clients carry on business in a wide range of sectors, including hospitality, retail, consumer goods, gaming, manufacturing, property management, banking and finance. Trevor is the Hospitality sector lead as part of the firm’s National Retail and Consumer Markets group.

Kevin Lo

With over two decades of experience, Kevin Lo is a court recognized expert in digital forensics and eDiscovery, providing assistance to legal counsel and clients in all areas involving digital evidence.Kevin is a Certified Information Security Professional (CISSP), Certified Computer Examiner (CCE), Certified Forensic Investigator (CFI), Project Management Professional (PMP) and an EnCase Certified Examiner (EnCE). He has published many articles and is frequently interviewed by media outlets regarding digital forensic investigations, information security, and eDiscovery. Kevin regularly presents and conducts talks in numerous professional, technical, and industry conferences and seminars in the area of technology and forensics. He is currently a part-time instructor at a post-secondary institution lecturing on digital forensics and eDiscovery, as part of a post-graduate certificate program.

Shane D'Souza

Shane is Co-Head of McCarthy Tétrault’s Securities Litigation Group, the Firm’s Critical Situations & Shareholder Activism group, and a member of our Board of Partners. His national practice focuses on complex securities litigation, proxy contest litigation, shareholder disputes, M&A litigation, corporate governance, regulatory and enforcement matters, and disputes involving wealth, capital markets and crypto businesses. He also has significant experience in securities class actions and recently co-led one of the few common issues class actions to proceed to trial. Many of his files have a cross-border component.
