Go-To Guide:
  • On May 1, 2026, the Consumer Financial Protection Bureau (CFPB or Bureau) published a Final Rule amending Subpart B of Regulation B, which implements the Equal Credit Opportunity Act (ECOA), to revise the 2023 small business lending data collection and reporting rule implementing Section 1071 of the Dodd-Frank Act.
  • The Final Rule narrows coverage by (1) raising the covered institution origination threshold from 100 to 1,000 originations per year; (2) categorically excluding Farm Credit System lenders and agricultural loans from coverage; (3) excluding merchant cash advances as well as any small-dollar loans of $1,000 or less from covered credit transactions; (4) reducing the “small business” revenue cap from $5 million to $1 million; and (5) eliminating five discretionary data points from the report: application method, application recipient, denial reasons, pricing information, and number of workers.
