United KingdomCorporate/Commercial Law
In cyberspace your brand name could be your competitor's greatest advantage and businesses must keep a close eye on their trademarks.

The warnings come after Estée Lauder filed a law suit in the US against Fragrance Counter Inc. and Excite Inc. after it was discovered that Fragrance Counter, who are not an authorised retailer, was using the Estée Lauder name for its own online business.

Excite is one of several "search engines" available on the Internet. Operating as sophisticated index pages they enable users to access sites using keywords rather than web addresses. Fragrance Counter had purchased the rights to the keyword "Estée Lauder" from Excite and any searches on that name brought up a page on which Fragrance Counter was advertising.
