Green (Liquidator of Stealth Construction Limited) v Ireland [2001] EWHC 1305 (Ch)
Statute requires guarantees and contracts for the sale of land to be in writing and signed. A 2006 case, J Pereira Fernandez SA v Mehta is authority for the proposition that an exchange of emails can constitute signing for the purposes of a guarantee. There needs to be an addition of signatures to the foot of an email, not merely an automatic addition by the email system.
Pereira has now been applied in this case to make it clear that a contract for the sale of land can also be formed by an exchange of emails.
