Career

Ninoshka is a partner in Consortium Legal – Guatemala. With more than 20 years of experience in the legal advice to companies and small entrepreneurs; she specializes mainly in the advice, protection and defense of the rights that assist the owners of distinctive signs, of Denominations of Origin, Geographical Indications, domain names and the rights that assist the owners of works of Copyright. Advises on issues of trademark abuse, seeking above all an amicable settlement rather than a long and costly trial for the parties. Together with the litigation team, they advise on the defense and presentation of legal actions related to copyright infringement in criminal matters, border measures, actions for unfair competition, nullity, cancellations for lack of use of trademarks and litigation for violation of distinctive signs. Advice on the negotiation and drafting of various contracts, including the assignment of trademarks and licenses of use, various contracts related to copyright (artists, musicians, image rights, etc).

During her career she was the country’s (Guatemala’s) Delegate to the Inter-American Association of Intellectual Property -ASIPI- (2013-2018) having been part of its Sub-Committee on Geographical Indications from 2013 to 2022. She has also been part of several committees of the International Trademark Association (INTA) and is currently a member of the Harmonization of Trademark Law and Practice Committee of INTA (2018-2021).

She has more than 15 years of teaching experience, having been one of the first professors who started the Intellectual Property Course in two Universities in the country. Likewise, she has more than 15 years as a lecturer and trainer in intellectual property issues for public and private entities. She also has experience in the selection of experts/collaborators in the elaboration of digital works related to current intellectual property issues, having recently collaborated with two works related to Geographical Indications, published by the Inter-American Association for the Protection of Intellectual Property -ASIPI-.

WORK HIGHLIGHTS

  • Protection of more than 100 European Designations of Origin or Geographical Indications and defense of any of them, including legal actions and appeals.
  • Preparation and presentation of the Terms and Conditions of the first Denomination of Origin in Guatemala, Antigua Coffee, and its respective modification.
  • Elaboration and implementation of Trademark Policy in entities of the Food sector

Ninoshka Urrutia – Consortium Legal

Hailed for its ‘wide range of experience‘, Consortium Legal‘s IP team can draw on both the firm’s presence across Central America and its ‘network of legal contacts throughout the world‘ to assist some of the most prominent multinationals in Guatemala with the management of their domestic and international IP portfolios. The department has particular strengths in the food and beverage and pharmaceutical sectors, with a practice that spans the gamut of trademark, patent and copyright matters. It is also well versed in domain names, geographical indications and advertising issues for clients in the retail and hospitality industries, taking advantage of the firm’s region-wide IP software to organise clients’ information. On the contentious side, the team frequently handles cancellation, unfair competition and, particularly, infringement actions. Ninoshka Urrutia, who is widely recognised for her extensive IP experience, leads the practice. She is supported by up-and-coming associate Stephanie Arévalo, who heads the international department (specialising in the registration of trademarks worldwide) and patent department.
