Position

Mala Ahuja Harker splits her practice between white collar/investigations work and complex commercial litigation, representing individuals and corporations in the financial services, pharmaceutical, and other industries.  In addition to her significant white collar and litigation practice, Ms. Harker is a member of Friedman Kaplan’s Management Committee.

Career

Ms. Harker was a Friedman Kaplan partner prior to leaving the firm in 2011 for a position as an Assistant U.S. Attorney for the District of New Jersey, where she served for six years before returning to Friedman Kaplan in 2017.  During her time at the D.N.J., Ms. Harker investigated and prosecuted cases involving public corruption, sophisticated financial frauds, insider trading, securities violations, mortgage and bank fraud, tax evasion, money laundering, identity theft and cybercrime, as well as violent crime and drug offenses, among others.

Her recent experience includes:

• Representation of the Chief Financial Officer of an international media company in connection with an internal investigation.
• Representation of an individual in connection with a DOJ investigation involving potential violations of the False Claims Act and criminal wire fraud charges.
• Representation of a senior executive of a generic drug manufacturer in connection with a criminal investigation and related civil shareholder actions.
• Representation of the founder of WeWork challenging the decision of its majority institutional shareholder to terminate a multi-billion dollar tender offer.

Memberships

Ms. Harker is an active member of the Women’s White Collar Defense Association and the White Collar Crime Subcommittee of the New York City Bar Association’s Women in the Legal Profession group.  Beyond her white collar practice, she works with multiple organizations that advance gender equity and women’s rights within the workplace, is Friedman Kaplan’s Management Committee representative on the Leadership Council on Legal Diversity, and serves on the Board of Trustees of Volunteer Lawyers for Justice.
