Career

Catherine Carroll is a nationally recognized appellate litigator with more than 15 years of experience briefing and arguing cases on a wide range of issues in the US Supreme Court and the federal courts of appeals, representing clients in district court litigation, and counseling clients on matters raising complex legal questions. She has argued four cases and briefed dozens more before the US Supreme Court and argued numerous cases in federal appellate courts across the country.

Ms. Carroll serves as partner-in-charge of the Washington DC office.

Ms. Carroll’s practice spans a wide variety of statutory, regulatory and constitutional issues. Her recent matters have involved such diverse areas as data privacy, the Administrative Procedure Act, ERISA, insurance and reinsurance, antitrust law, First Amendment law, and criminal law and procedure. In addition, she frequently represents clients on a pro bono basis in cases raising significant issues of constitutional law and capital habeas procedure.

In recent years, Ms. Carroll has been recognized as a nationwide leader in appellate advocacy by Chambers USABest Lawyers in AmericaLegal 500 United States, and other legal publications.

Before joining the firm, Ms. Carroll served as a law clerk to Associate Justice David H. Souter of the US Supreme Court. Previously, she clerked for The Honorable Harry T. Edwards of the US Court of Appeals for the District of Columbia Circuit.

Professional Activities

Ms. Carroll serves as Chair of the Standing Committee on Amicus Curiae Briefs of the American Bar Association and is a member of the Edward Coke Appellate Inn of Court.

An appellate powerhouse, WilmerHale presented twenty-seven oral arguments in the first six months of 2023, including two before the US Supreme Court. The group routinely appears before appellate courts across the country, with particularly vast experience in the Federal Circuit, as well as in the Ninth, Fourth and First Circuits. Boston-based department co-chair Mark Fleming has argued 62 appellate cases, including eight SCOTUS appeals, and is highly regarded for his record in patent cases before the Federal Circuit. The deep bench also includes practice vice-chair Catherine Carroll, who has argued four SCOTUS cases; fellow vice-chair Daniel Volchok, who has niche expertise in Native American law; Thomas Saunders, who specializes in IP appeals; and New York-based Alan Schoenfeld.
