Gregory Toh is a Partner in Oon & Bazul’s Litigation & Dispute Resolution Practice.

Gregory has extensive experience in complex commercial disputes with an emphasis on shipping & admiralty, international trade as well as fraud and asset recovery. His expertise has found him on the cutting edge of the law in both the shipping and insolvency spheres.

Gregory is an Accredited Specialist in Maritime and Shipping Law. He regularly handles charterparty and bill of lading disputes and has substantial experience in international trade disputes including quantity and quality disputes. Gregory also routinely handles admiralty matters. He has substantial experience in the full admiralty process from vessel arrest and release to post-arrest matters such as moderation of security, setting aside of arrest and judicial sale.

Gregory has also assisted numerous clients to achieve recovery in challenging multimillion dollar cross-border fraud and conspiracy matters by obtaining and policing asset disclosure and freezing orders as well as obtaining judgment.

Notable Cases:

• Acted for a client to obtain an injunction restraining a creditor from commencing winding up proceedings on the basis of an unpaid partial final award. The injunction involved the issue of whether the creditor was entitled to pursue winding up proceedings in Singapore notwithstanding ongoing arbitration proceedings. The decision is reported in Fastfreight Pte Ltd v Bulk Trident Shipping Ltd [2022] SGHC 210.

• Successfully acted for bunker barge owners to defeat a misdelivery claim in the landmark decision of The “Luna” and another appeal [2021] SGCA 84. The Singapore Court of Appeal held that documents labelled “bills of lading” issued by local bunker barge operators were not true bills of lading that evidenced contracts of carriage or functioned as documents of title.
