Position

Malcolm Harding S.C is a trial and appellate barrister with extensive litigation experience.  Malcolm has practised as a barrister since 2003. He was appointed Senior Counsel in 2019.

Career

Malcolm mainly practises in industrial and employment law. In terms of the areas of law that it engages and the forums in which legal disputes arise, the practice area is very broad (it is recognised by both the Federal Court and the Supreme Court as a specialist area of practice). Malcolm has extensive experience in all areas of this practice area. He also appears in public law and anti-discrimination matters and appeals.

Malcolm regularly appears in the Federal and Victorian courts in trials and appeals, as well as tribunals such as the Fair Work Commission and the Victorian Civil and Administrative Tribunal.

Malcolm is recommended by Doyle’s Guide in the industrial and employment law field (including prior to his appointment as a silk). This year he was also nominated by his peers for inclusion in the 2021 edition of Best Lawyers in Australia for industrial and employment law.

Malcolm is a member of the Industrial Bar Association, the Victorian Bar’s Equality and Diversity Committee and has been a member of the Victorian Bar’s Human Rights Committee.
