Stuart’s areas of practice include general commercial, financial services and private client work. He joined the firm in May 2015, having previously held the position of Tax Manager at Grant Thornton.

Stuart has a strong background in tax and has become the “go to” lawyer within the firm for all tax matters. He is presently involved in advising High Net Worth Individuals on the establishment of tax efficient structures and cross-border planning. He often presents on tax issues affecting the jurisdiction, such as the application of the International Tax Treaty entered between the Kingdom of Spain and the United Kingdom (which has constitutional responsibility for Gibraltar’s foreign affairs) in relation to taxation, and the Tax Treaty entered between the United Kingdom and Gibraltar, which came into force in March 2020. Stuart has also co-authored a number of high-profile industry publications, including the Gibraltar chapter of the Legal 500 Tax 3rd Edition Country Comparative Guide.

Stuart has recently been appointed by the Government as a member of the Business Licensing Authority (BLA). The BLA forms part of the Office of Trading (OFT) and is responsible for the issue, renewal and administration of business licenses in Gibraltar. The role of the BLA, in conjunction with the Consumer Protection Division of the OFT, is to ensure a level playing field between businesses for the ultimate benefit of consumers and the local economy.

Stuart also works very closely with ISOLAS’ Fintech team, and regularly advises blockchain companies in setting up businesses in Gibraltar and on any corporate, tax and regulatory aspects concerning the company’s business in Gibraltar. Stuart has acted for many high-profile clients in assisting with obtaining a licence with the Gibraltar Financial Services Commission (GFSC) under the Financial Services (Investment and Fiduciary) Act 1989 as a DLT Provider, such as Bitso, the first cryptocurrency exchange in Latin America to obtain a DLT Licence.

Notably, Stuart played a pivotal role in assisting the Partners in advising the Gibraltar Stock Exchange with its regulatory permissions granted by the GFSC to cover the use of Blockchain or DLT by issuers as a means or recording ownership. As a result, firms can now allow listing of corporate bonds, asset backed and derivatives securities, as well as open-ended and closed-ended funds in a digital or tokenised form.
