Guzmán Ariza

Guzmán Ariza covers the full range of corporate and finance matters and benefits from being able to call on an in-house group of over a dozen accountants who assist with the structuring of credit facilities and the tax-efficiency aspects of transactional matters. Fabio Guzmán Ariza leads the ‘dynamic, sophisticated’ practice, with strong support from Fabio Guzmán Saladín and Alberto Reyes in the Santo Domingo office, and Alfredo Guzmán in Punta Cana and La Romana. The practice group’s experience in contract law is worth noting; in 2016 it acted for logistics company Mammoet Caribbean on its contractor agreements with subcontractors, and on its service agreement with the Dominican government, regarding the company’s $100m participation in a $2bn coal power plant project. The team also advised US energy company Phillips 66 on compliance with DR-CAFTA regulations; and assisted Fastenal and Wolverine Worldwide with all their corporate, labour and tax requirements. Other clients include Francisco Martínez Group, Tecnove Group and Credit Suisse International.

Today full service, Guzmán Ariza was originally a litigation boutique; it continues to enjoy an established reputation for real estate, labour and commercial disputes, and with the hire of litigator Michel Camacho (who arrives as of counsel from Salcedo & Astacio), is increasingly strong in white-collar matters. The practice group, which also handles arbitration, is led by Fabio Guzmán Ariza, who recently acted in conjunction with Alfredo Guzmán to advise Wells Fargo on a complex $2.5m property foreclosure. The practice is especially active in the tourism sector, where clients include Sunwing Travel Group, Lifestyle Holidays Vacation Resort and Meliá Hotels International, and genuine strength-in-depth comes from deeply experienced partners Rhadaisis Espinal, Julio Brea-Guzmán and Alberto Reyes, who each have more than 20 years’ experience in civil, commercial and administrative litigation, and former criminal appeals court judge Manuel Ulises Bonnelly. In other work, the team has been retained by Holland & Knight to act as an expert consultant on local law in a $50m case brought against the government of the Dominican Republic. Family law litigation specialist Aura Celeste Fernández is also noted. Other clients include developers Constructora Armenteros and Antonio Brugal Sucesores; manufacturers Productie Zarah Moden and Truper Herramientas, Avior Airlines, Grupo Estrella and First Bank of Puerto Rico.

Praised for its ‘level of service and results’, the ‘experienced’ IP team at Guzmán Ariza is best known for its work in the trade mark subsector. However, it also frequently handles copyright and patent work and is increasingly active in piracy and privacy matters. Practice head Fabio Guzmán Saladín has ‘a firm grasp on business solutions’, and leads on a workload in which trade mark related matters have predominated of late. Nevertheless, around a third of mandates in the sector are of a contentious nature and here ‘excellent litigatorAlberto Reyes is highlighted as a ‘real fighter’. Clients include Honda Motors, Gold Star Tobacco, Uniconf and Fuxion Biotech, and the team was further strengthened by the arrival of Pamela Benzán in August 2016.

Renowned for its strength in condominium-related matters, Guzmán Ariza has much experience in the hotels space. The team, which is led by Fabio Guzmán Ariza from Santo Domingo, provides advice on all kinds of real estate issues, including contentious matters. Moreover, it combines strength-in-depth with an unmatched geographical presence: Guzmán is supported by Rubén García and César Calderón in Samaná, Julio Brea Guzmán in Sosúa-Puerto Plata and Christoph Sieger in Bávaros-Punta Cana. The firm also has offices in Las Terrenas, Cabrera and La Romana. The department assists Club Mediterranée, Meliá Hotels International and Noval with all their real estate work. Other recent mandates saw Guzmán and Brea advise a group of Canadian and Dominican investors on their $3m sale of an unfinished 400-room beachfront hotel (and adjacent properties).
