Experienced in civil and commercial litigation that includes disputes relating to companies, shareholders and directors, insurance, contracts and employment contracts. She regularly advises companies on potentially litigious matters, involving breach of fiduciary duties, breach of confidentiality obligations, breach of non-competition and non-solicitation clauses. She also represents clients in disputes involving intellectual-property rights. Specialises in medical and healthcare matters. She regularly acts for patients seeking redress against hospitals and medical practitioners through medical negligence claims.
Work Highlights
Matters of significance in which Man Phing has been involved in include acting for the following:
- Singapore Swimming Club in various proceedings in the High Court and Court of Appeal including claims on restitution, breach of fiduciary duties and breach of natural justice.
- The executors of the estate of the deceased, who sued AIA Singapore Pte. Ltd., an insurance company for benefits under two personal accident policies for the death of the deceased, and succeeded on appeal to the Court of Appeal. The issues relating to the interpretation of the policies are novel and first of its kind in Singapore.
- Cordlife Group Limited, a major player in Singapore’s cord blood banking services industry, in a High Court claim for passing off, trademark and copyright infringement against a rival, where an interim injunction was obtained on an urgent basis to compel their rival to take down their website and obtained damages. Also advised Cordlife Group Limited on the licensing and regulatory requirements, and potential liabilities of its proposal to offer genetic testing to its clients.
- A premier social club in Singapore in its claim against an architectural firm for negligence and breach of contract in carrying out the works under the club’s S$20 million upgrading project, which include designing the cabana roofs and the multi-storey carpark extension.
- Dubai Healthcare City (“DHCC”) in its review of their statutory framework governing healthcare operators and professionals, and to draft a comprehensive set of regulations to govern and regulate healthcare and research practices within DHCC.
- Merck Group, a U.S. pharmaceutical company in a lawsuit commenced in Singapore that was related to the worldwide class actions involving the recall of a pharmaceutical drug.
