Position

Andrew is a Dispute Resolution & Litigation Partner based in the firm’s Manchester office. He is experienced in dealing with heavyweight and complex contractual and commercial disputes, as well as corporate and shareholder disputes, cross-border litigation, regulatory and public law disputes, data breach  and professional negligence claims. His experience and expertise extends to managing disputes throughout Europe, Asia, USA and Africa, with a number of his cases having been reported in the UK and Worldwide.

Andrew also has considerable experience in managing technology and telecoms disputes, and advising on telecoms regulatory disputes, having acted over the last 20 years for a number of leading domestic and international telecoms operators and resellers, including Virgin Media O2.

His recent cases include:
• successfully representing a national telecoms company both in the High Court and the Court of Appeal in its multi-million claim for restitution;
• successfully representing a national telecoms provider in discharging an injunction for alleged anti-competitive practices, and striking out the claim;
• acting for an interested party in judicial review proceedings of national importance to the education sector;
• leading a multi-disciplined litigation and data protection team on a data breach, the multi-agency response and threatened litigation.

Andrew’s approach is focussed on the delivery of commercial advice, aligned to the client’s business model and risks, to help devise strategies to avoid litigation wherever possible and to assist clients in navigating their way through any dispute.

Andrew is identified as a leader in his field in both Commercial Litigation and IT & Telecoms by Legal 500 in which he is described as “standing out for his strategic guidance and commercial nous” and “is an excellent leader who combines first-class management skills with attention to detail”.

The practice’s specialism is telecoms real estate and infrastructure, with the team overseeing transactions in this area and helping its clients to ensure their equipment complies with new building safety regulations. Catherine Haslam is recommended for work relating to the interplay of real estate and telecoms. Further standout work includes assisting a Home Office project aimed at improving connectivity in ‘not-spot’ areas – such as in Cumbria, High Peak and the Dales – and advising on projects to improve internet connections at major football grounds. Frank Shephard is also key, handling corporate matters for large mobile network providers. Andrew Whalley leads the dispute resolution arm of the practice.
