What Is an E-2 Visa?

An E-2 visa is a Treaty Investor visa within the broader category of nonimmigrant visas, allowing a national of a treaty country to enter and work in the United States based on a substantial investment in a U.S. business that the investor actively directs and develops. Unlike immigrant visa categories, E-2 visas do not lead directly to a green card. More than 80 countries have E-2 treaties with the United States, and E-2 status is generally granted for up to two years at a time. Instead, the visa is renewable in increments for as long as the qualifying business continues to operate and visa holders continue to meet the applicable requirements.

E-2 visas are available only to nationals of countries that maintain a qualifying treaty of trade and commerce with the United States, which is why nationality is one of the first issues our attorneys evaluate when a prospective investor asks about a USA visa E2 application.
