In its ruling of 14 October 2024, the Court of Appeal at Arnhem-Leeuwarden (the Court of Appeal) further elaborated on the scope of the employer's redeployment obligation (herplaatsingsplicht) in the event of a dismissal due to organisational changes. In summary, the Court of Appeal ruled that the employer made insufficient efforts to redeploy the employee by failing to discuss vacancies with the employee in a redeployment conversation, failing to actively investigate whether other vacancies could be suitable possibly with the help of training and wrongly assuming that the employee was unwilling to work at a foreign company within the employer's group. In this news item we will further elaborate on this ruling.
