最高人民法院（最高裁）が先日、「知的財産権法廷年度報告書（2022）」を発表した。昨年、最高法院の 知的財産権法廷は各種の技術類知財事件と独占関連の上訴事件合わせて6183件を審理した。この中で昨年に新たに受理した事件は4405件、結審した事件は3468件であった。
知的財産権法廷が昨年に審理した事件に、▽権利侵害事件が増加傾向を続ける▽行政事件がやや減少▽戦略的新興産業関連の事件の比率が拡大▽審級機能の役割が強化――という4つの特徴が見られる。
訴訟の内容を見れば、次世代情報技術やバイオ医薬、先端設備製造、標準必須特許、医薬品パテントリンケージ、集積回路配置図設計、植物新品種などの新産業、新領域に関わる事件が明らかに増加しているという。
