中国国家知識産権局（CNIPA）がこのほど、知的財産権行政裁決事件でオンライン審理を活用する際に適用する「 行政裁決事件のオンライン口頭審理弁法」を公表した。権利者と一般ユーザーの正当な権利と利益を守り、事件当事者の行政裁定手続き参加を容易にするとともに、権利行使のためのコスト削減と行政の効率化を図ることが目的だという。
「弁法」は全18条からなり、オンライン審理の対象として、重大な特許侵害紛争に関わる行政裁決事件医薬品特許紛争の早期解決メカニズムに関わる行政裁決事件集積回路配置設計の専有権紛争に関わる行政裁決事件その他のオンライン口頭審理に適した行政裁決事件などを挙げている。
この「弁法」は公布日より施行されるという。
