Philip has been a Partner at Capsticks since 2002, a Nominated Partner for NHS Resolution for over 10 years and he leads the firm’s national inquest service.   Philip works with clients in the health and social care, insurance and emergency services sectors to resolve and learn from claims, inquests and serious incidents.

Philip also has judicial experience, having worked for five years as an Assistant Coroner.

Notable projects

Lead Solicitor to the NHS on the Jimmy Savile investigations and handled all claims arising from the abuse.

Representing the LAS in the Inquests following the Terror Attacks at Westminster Bridge/Palace of Westminster and London Bridge/Borough Market.

External legal advisor to the DHSC project delivery group for the Independent Investigation into Child Sexual Abuse.

Defendant clinical negligence representative in the High Court User group and met with Lord Justice Jackson during his review into the costs of civil litigation.

Trial wins in numerous claims ranging from small value to injuries of maximum severity worth several million pounds. Philip has also represented clients in the Court of Appeal and the Supreme Court.

The team at Capsticks LLP is co-led by Peter Marquand and Catherine Bennett, and also fields such seasoned names as Philip Hatherall. It has been on the NHS Resolution’s ‘Clinical Negligence Scheme for Trusts’ panel since 1995 and on its ‘Clinical Negligence Scheme for General Practice’ panel since 2019. The workload consists of high-value, complex, multi-party claims involving such issues as birth injury, brain injury, cerebral palsy, spinal injury and wrongful birth. The team’s ethos is to aim for non-contentious resolution. The group’s high profile Covid-related mandates, wherein it is defending proposed breaches of duty at the height of the pandemic, are novel as to their circumstances and, as such, of national interest and likely to influence future case law, once settled. Majid Hassan leads a sub-team which is focused specifically on medical malpractice, representing insurers in claims brought against private surgeons, clinics and hospitals. Tamara Knight is a recently appointed partner with an impressive caseload.

In Leeds, Capsticks LLP is a key advisor to NHS Trusts across the north of England, sitting on the NHS Resolutions Clinical Negligence Scheme for Trusts panel since 1995. Counterfraud and fundamental dishonesty claims are key areas of strength for the team, with associate Ruth Day taking a lead on these cases. The group has also seen continued growth in its inquest work, regularly handling sensitive and high-profile matters. Key partners include group litigation specialist Philip Hatherall; trial lawyer Dominic Ip; head of private healthcare sector Ian Cooper; and inquest advocate Adam Hartrick. Emily Senior departed in October 2021 to DAC Beachcroft LLP, while Keith Blundred joined the team from DAC Beachcroft LLP in March 2022.
