Conviction for an offence under the 1996 Act will make any participating undertaking or individual liable:-

  • on summary conviction (for minor offences), to a fine not exceeding IRo1,500 or, in the case of an individual, to such a fine or, at the discretion of the Court, to imprisonment for a term not exceeding 6 months or to both such fine and imprisonment;
  • on conviction on indictment (for more serious offences), to a fine not exceeding the greater of IR£3,000,000 or 10% of the turnover of the undertaking in the financial year ending in the 12 months prior to the conviction or, in the case of an individual, to such a fine or, at the discretion of the Court, to imprisonment for a term not exceeding 2 years or to both such fine and such imprisonment;
  • in the case of an undertaking which is convicted in summary proceedings for contravention of the 1996 Act, the undertaking will be guilty of a further offence making it liable to a fine not exceeding IR£1,500 for each day on which the contravention continues after the conviction.
