  1. Assisted a major IT security services company in setting up its operations in India, drafting and reviewing of the entire HR documentations including the HR policy, contracts, and service-related agreements. The Firm also assisted client with their in-house employment training sessions, sexual harassment policies and various other employment matters.
  2. Advised and assisted a foreign company on inbound and outbound transfer, cross border secondment, employee leasing, expatriates, and consulting services. The assignments also included preparation of drafts of temporary assignment/ secondment agreement for employee to be seconded inbound or overseas besides advising on practical considerations in matters related to taxation, immigration laws & social security laws etc.
  3. Advised a company on central and state wise laws related to managing workplace monitoring, surveillance and privacy in India, installation, and operation of surveillance cameras at workplace, regulatory requirements, legal risks etc. The Firm assisted the client in drafting employment policies for the company, labour compliance checklists for their offices situated across India and advising on employee redundancy, domestic enquiry, matters pertaining to sexual harassment of women at workplace, litigation strategy and ongoing employment and labour law related matters.
  4. Advised and assisted a company on disputes related to cessation of employment of a senior level employee on allegations of misconduct and performance. The assistance and advisory also included documentation for termination of services of managerial employee.
  5. The Firm received favourable judgment by successfully defending the client in a claim filed by ex-employee before the court claiming reinstatement in employment, back wages, and other reliefs, etc. In earlier round of litigation, the ex-employee failed to challenge the judgment by high court by filing appeal before the Supreme Court of India.
  1. Assisted a global content and film production company in a high-profile investigation conducted by us against members of its senior management, in relation to allegations levelled by an ex-senior level employee regarding workplace practices. The Firm advised on mitigating exposure and corporate liability for the client due to the acts of its employees.

Our lawyers regularly assist companies on compliance issues, employment and consultancy agreements, director agreements, contractor agreements, employee handbooks/standing orders, employee benefits and compensation, employee share schemes, restructuring, lay off, redundancies, closures, relocation, transfer of business, outsourcing arrangements, union agreements and/or employee disputes in different forums in several Indian states, labour courts, industrial tribunals, high courts and Hon’ble Supreme Court of India.

 

The team also advises and assists in matters involving disciplinary inquiries, prevention of sexual harassment matters, statutory compliances including benefits and any related disputes and/or contentious matters.
