Winston & Strawn’s eDiscovery and Information Governance Practice brings years of real world experience and knowledge to the complex areas of eDiscovery and information governance. Our “Process, Analytics, and Technology” approach centers on controlling overall eDiscovery costs across the entire Electronic Discovery Reference Model (EDRM) as well as implementing document retention and management protocols to minimize future disruptions. As part of this process, we help clients minimize the risks associated with eDiscovery through the implementation of defensible, repeatable processes designed to meet our clients’ unique situations.

The eDiscovery practice is guided by John Rosenthal, a recognized leader in the eDiscovery industry, and includes partners, counsel, and associates from across the firm, as well as experienced project managers located throughout our offices. We offer a truly global approach to eDiscovery and are prepared to meet head on whatever challenges our clients face.

The eDiscovery group offers clients a broad spectrum of services, ranging from litigation-readiness planning, document and information management, and international and cross-border eDiscovery to traditional collection, processing, and review services. At each level, we strive to provide best-in-breed service through the use of state-of-the-art technologies and dedicated, knowledgeable individuals.

LITIGATION READINESS

Clients often overlook the importance of having proper procedures and protocols in place before they become subject to litigations and/or investigations. The eDiscovery practice works with clients to design a holistic approach to litigation that stresses the need to design reasonable, defensible processes regarding responses to litigation, preservation, collection, and ultimately the review of relevant information for production.

DOCUMENT AND INFORMATION MANAGEMENT

Information governance is important to all of our clients. The eDiscovery practice helps clients design and implement systems to manage their documents and information with the goal of intelligently reducing the total volume of information that could potentially be subject to discovery, thereby reducing the client’s overall eDiscovery spend.

PRESERVATION AND COLLECTION

Clients face dangers associated with both over- and under-preservation. The eDiscovery team takes a reasonable and targeted approach that ensures clients preserve sources of relevant information but don’t bring the entire company to a halt. We use industry-leading technologies that ensure the integrity of our client’s data.

PROCESSING AND REVIEW

The eDiscovery practice employs state-of-the-art analytical tools that enable us to reduce the total number of documents subject to processing and to conduct early case assessments before processing and reviewing vast volumes of data. Our Review Center furthers this process by using a cutting-edge review platform coupled with powerful analytical tools, including predictive coding, to reduce the volume of data reviewed by our lower-cost, dedicated document review attorneys.

INTERNATIONAL AND CROSS-BORDER EDISCOVERY

The eDiscovery team of international and cross-border data transfer experts ensures that our clients comply with international privacy and data protection laws and regulations in the context of international litigations, investigations, and other proceedings.

NATIONAL COUNSEL FOR EDISCOVERY

The eDiscovery practice serves as national eDiscovery counsel for a number of Fortune 500 companies, helping them navigate through this complex area of the law and ensure that the processes and procedures they implement are designed to reduce the costs and risks associated with litigating in today’s world.
