RCN Televisión SA and Foxtelecolombia SA (currently Tis Productions SAS):

Counsel in a proceeding to request the recognition and enforcement of an international arbitration award seated in Miami.

The underlying arbitration resolved a dispute regarding a Colombian television series of the life and work of Celia Cruz, one of the most famous salsa singers in history. The dispute involved the executor of Celia Cruz, as well as different jurisdictions and languages. Our Firm counseled our client in that arbitration and obtained a totally favorable award to our client.

The enforcement of the arbitral award will allow the companies to collect the legal costs that were awarded by the tribunal because it dismissed the entirety of the claims and concluded that the claimants had engaged in different misconducts during the arbitration.

Oxígenos de Colombia Ltda:

Counsel in a dispute derived from a contract to provide transportation to support our client’s logistical operation in distributing its goods in several cities in Colombia. Our client terminated the agreement upon the contractor’s serious breach of its obligations. The contractor filed a lawsuit claiming that the agreement was wrongfully terminated and requesting compensation of damages.

Gecelca 3 S.A.S. E.S.P.

Counsel in a setting aside proceeding against an international arbitration award initiated by the Chinese Consortium CUC-DTC. This decision is part of the so-called “Gecelca saga” to which the Colombian arbitration community has paid close attention and that has been discussed in different academic fora.

USG Corporation:

Counsel in a judicial claim initiated by Comcel S.A., the largest telecommunication actor in Colombia also owned by Carlos Slim, against the Colombian Telecommunications Agency. The claim involves a previous decision of the Colombian Telecommunications Agency to impose higher off-net calls tariffs to Comcel, due to its dominant position in the market.

Gecelca 3 S.A.S. E.S.P:

Counsel in a motion to set aside an international commercial award before the Colombian Council of State. The award was set aside. This is the first time that Council of State set aside an international award under the new arbitrarion law (1563 of 2012)

Isagen S.A. E.S.P. and Chivor S.A. E.S.P:

Counsel in the strategy to defend the interest of two leading companies in the energy sector, bringing a Restoration of Rights and Nullity Action against the Colombian Gas & Energy Agency CREG regarding the issuance of an executive order that modified the Companies’ remuneration on Colombian Market Energy with retroactive effects.

International arbitration:

The International Arbitration practice counts with lawyers that have a wide experience in international dispute resolution. The scope of our team’s work spans from preventive dispute advice to the conduction of international arbitration proceedings before the principal arbitration institutions in the world. Our practice mainly focuses on construction and engineering litigation, with a vast experience in administration and evaluation of contractor’s claims under EPC and EPCM contracts; corporate disputes (MOUs y joint ventures); energy and mining; international sale of goods; real state litigation; international factoring and derivative litigation; and commodities sales.
