CAT stays action for damages

The CAT has published an order, staying a claim for damages, brought by 15 claimants against Tessenderlo Chemie N.V. and its UK subsidiary, Britphos Limited, for alleged damages resulting from the animal feed phosphates cartel. The CAT's order provides that the claim be stayed for three months from the date of the order to allow the parties to enter into settlement discussions. Click here.

The CAT has dismissed an appeal by Telefónica against Ofcom's determination of a dispute between Telefónica and each of H3G and Vodafone about mobile termination charges. Click here.

OFT

The OFT has referred the completed acquisition by Eurotunnel of certain assets of former ferry operator, SeaFrance to the CC. The CC will now establish whether the acquisition may be likely to result in a substantial lessening of competition in any markets for goods or services in the UK. Click here.

The OFT is considering whether to accept undertakings offered by Rexel UK Limited in lieu of referring its completed acquisition of the Wilts Wholesale Electrical Company Limited business to the CC. Click here.

The OFT has decided to accept undertakings from Boparan Holdings in lieu of referring its completed acquisition of R F Brookes and Avana Bakeries Limited to the CC. Following concerns that the merger would bring together the two largest suppliers of Christmas puddings in the UK and potentially lead to price rises for consumers, Boparan has offered to sell one of two Christmas pudding manufacturing businesses.
