Welcome to the October 2026 edition of our newsletter, which explores recent competition law developments across the UK and EU.

The end of summer and the start of autumn have brought with them some notable decisions and developments.

In the world of behavioural investigations, the EU General Court has re-affirmed the European Commission’s ability to compel the production of communications with overseas in-house counsel, even where they benefit from legal privilege under the laws of third countries. We have also seen the Commission publish its final guidelines on exclusionary abuses of dominance, which set out a clear analytical framework for the enforcement of Article 102 TFEU against such conduct. Meanwhile in the UK, the CMA has, for the first time, imposed (significant) fines on individuals for concealing evidence during an inspection. It has also been very active in the use of its new consumer enforcement powers.
