European Commission accepts commitments offered by Penguin in e-books case

The European Commission has accepted commitments offered by Penguin to address competition concerns relating to the distribution of e-books in the EEA. As part of the commitments, Penguin will terminate relevant agency agreements with Apple and with other retailers and will not limit or impede e-book retailers' ability to set, alter or reduce retail prices for e-books and/or to offer discounts or promotions for a period of two years. Further, Penguin will not enter into any agreement relating to the sale of e-books within the EEA that contains a most favoured nation price clause for a period of five years. The Commission accepted commitments from Apple and four other publishers in December 2012 as part of the same case. Click here.
