In advertising for employees, in interviewing, and in deciding who to appoint, employers must not discriminate on grounds of either an individual's sex or marital status. Any such discrimination exposes the employer, whether or not the individual becomes an employee, to a claim under Employment Equality legislation.

Care should be taken prior to offering employment to have a candidate medically examined to ascertain fitness to do the work. It is not usual, though it is not prohibited, to carry out drug or alcohol screening. All personal or previous employment references should also be checked prior to offering employment.

There must be no discrimination in relation to pay and conditions as between male or female employees doing like work.
