中国国家知識産権局（CNIPA）はこのほど、公式サイト上で「グラフィカル・ユーザー・インターフェース（GUI）を含む製品の意匠出願ガイドライン」を公表した。GUIを含む製品の意匠制度の適切な活用を支援するためのもので、関連する企業や研究機関などのイノベーション主体に向けた参考資料として位置付けられている。
同ガイドラインは▽意匠が認められる一般的要件、出願書類の作成要件、▽単一出願として提出できる具体的なケース、▽実務上の注意事項——の4章で構成されている。
GUIを含む製品の意匠制度の導入以降、イノベーション主体は意匠を通じてGUIデザインの創作成果を保護することが可能となっている。今回のガイドラインは、GUIを含む製品の意匠の特徴や出願実務のポイント、代表的な事例を分かりやすく整理することで、制度への理解を深め、出願書類や審査対応の質の向上を促す狙いがある。国家知識産権局はこのガイドラインを通じて、意匠制度のさらなる整備を進める方針だ。
