最近、上海知的財産権法院は、2015年から2020年までの不正競争事件に関する「裁判白書」及び「典型的事例」を発表した。「白書」によると、上海知的財産権法院は2015年から2020年まで、各種類の不正競争事件を950件受理し、同期の知的財産権事件受理件数の6.2%を占め、年間平均増加率は21.2%に達した。結審された事件が850件あった。
違法事由から見ると、「模倣・誤認混同」は72%、「営業秘密侵害」は14.3%を占め、その他、「虚偽宣伝」や「営業誹謗中傷」などに関わる事件もあった。
また、受理した不正競争事件の52.6％は他の 知的財産権侵害行為と絡み合っている事件であった。その中、商標権侵害に関わる不正競争事件が363件、著作権侵害に関わる事件が137件あった。
更に、事件の訴額が高いという特徴が見られる。訴額が500万元から1000万元の事件は24件、1000万元以上のは29件。その中、関連性のある2件の技術秘密紛争事件の訴額は2億3500万元も超えているという。
