Position
Olexander, partner at Sayenko Kharenko, specialises in dispute resolution and restructuring with a special focus on arbitration and commercial litigation. He advises local and foreign clients at all stages of dispute resolution proceedings, including complex multi-jurisdictional proceedings involving Ukraine, the UK, Cyprus, the BVI, Switzerland, The Netherlands and other fora, as well as commercial and investment arbitration under the arbitration rules of all major international arbitration institutions (LCIA, ICC, SCC), CIS-based arbitration institutions, ICSID Arbitration Rules and UNCITRAL Arbitration Rules. Mr Droug also advises clients on obtaining and implementing interim relief, including in support of arbitration proceedings and litigation, as well as on recognition and enforcement in Ukraine of arbitration awards and foreign court judgments.
Mr Droug has represented clients in proceedings relating to banking, financial services, securities, M&A, shareholders, trade, telecommunication, construction, energy, aviation, and product liability, as well as sports-related disputes. He also has significant experience representing both lenders and borrowers in financial restructuring and related disputes.
In March 2017, Olexander was added to the list of arbitrators elected to settle disputes arising in financial restructuring procedures.
Mr Droug regularly contributes to key legislation in the areas of arbitration, litigation and restructuring. For example, Mr Droug has recently been involved in drafting/amending the following draft legislation and/or regulations:
- participating in the working group of the Ukrainian Arbitration Association on development of a draft law on improvement of judicial support for international arbitration by the Ukrainian courts;
- advising the World Bank on the development of a draft law on financial restructuring (establishing a legislative framework for informal workouts and pre-packaged restructurings);
- advising the EBRD on the development of a draft law on derivatives (addressing close-out netting).
