Position

Maite Gaynicotche is an Associate in the Montevideo office. She actively participates in the Banking, Corporate and Data Privacy & Cybersecurity and Technology practice groups, providing assistance on a daily basis to local and international clients operating in Uruguay on banking and corporate law matters, as well as privacy and technology issues. She has also advised Banco Santander in numerous litigation processes regarding bankruptcy and asset recovery.

  • Banco Santander:Assessment on a permanent basis on banking, financing, regulatory, commercial and contractual issues, as well as restructuring, bankruptcy and asset recovery matters. In litigation, she has represented Banco Santander in major insolvency and bankruptcy proceedings, and asset recovery. Likewise, she participated in the due diligence processes of Grupo Santander for the acquisition of New Age Data, a Uruguayan company focused on the administration of payment terminals and the provision of payment solutions and services to the retail sector, with a strong presence in all departments of Uruguay; and Ecolicuá, an online car insurance comparison tool and purchase platform.
  • Creditel and Crédito de la Casa: Daily assessment on contractual, regulatory and commercial matters to Banco Santander’s retail financial services companies.
  • Paganza: Daily advice to Santander Group’s Electronic Money Issuing Institution (IEDE) on regulatory, commercial and contractual matters.
  • Zurich Santander Seguros:Daily assessment on insurance, regulatory, commercial and contractual issues.
  • FirstCaribbean International Bank:Provided advice as local counsel to FirstCaribbean International Bank, CaixaBank and Banco de Sabadell (Miami Branch) in their capacity as lenders in a secured term loan facility to Seawind Key Investments (and others). The purpose of the refinancing was the repayment of the facility obtained from the Inter-American Development Bank and FirstCaribbean International Bank for the construction of Breathless and Secrets Hotels in Jamaica.
  • Google Inc.: Advice in relation to local regulatory aspects, including regulations on consumer protection, data protection, protection of minors, media content and advertising, among others, in relation to the different projects and services that the company plans to launch in the country. In litigation, she participated in the ongoing leading case for the alleged right to be forgotten.
  • TikTok: Advice in relation to local regulatory aspects, including regulations on consumer protection, data protection, protection of minors, media content and advertising, among others, in relation to the different projects and services that the company plans to launch in the country.
