Career

David solves problems mainly for corporate clients, but also carries out work for some private individuals. This workload is divided between getting clients out of difficult situations and preventing clients getting into difficult situations.

David’s experience in different fields enables him to provide solutions for clients that are rounded and commercially focused. His primary concern is always to deliver value to his clients and advice that is easy to understand and action.

He is a specialist litigator advising clients in relation to high value High Court/Court of Appeal disputes and has dealt with a number of international/cross-border matters. However, the experience he has gained from advising on cases that have turned into a dispute is valued by clients who need advice about how to avoid them.

A good deal of David’s work is in relation to contracts, companies, partnerships and negligence – but he also advises in relation to contentious probate matters. He most enjoys handling complex cases with multiple issues requiring excellent legal knowledge and the ability to produce creative solutions.

David is also a solicitor advocate and he regularly appears in High Court cases against barristers.

Aaron & Partners LLP delivers a ‘first-class service’ across complex and high-value shareholder and partnership disputes; disputes arising out of corporate transactions; claims involving directors; restrictive covenants; property litigation and professional negligence. Key highlights included representing two directors of a group of food companies in a professional negligence claim against the companies’ former solicitors, and representing two Florida-based banks in the collection of mortgage shortfalls from British citizens who invested in the US property market. David Harries handles energy, engineering, construction and IT disputes, and is also noted for land and fiduciary obligations work. Also recommended are John Devoy, who is experienced in professional negligence cases, David Potts, who is noted for shareholder disputes, and David Mann, who was promoted to partner in 2017 and has ‘an excellent listening ear’. Simon Edwards and recently promoted associate Bryony Cook are also key members of the department, which is led by Nick Clarke.

Clive Pointon   heads the department at Aaron & Partners LLP  and James Wallace leads the contentious probate part of the team. David Mann is ‘quick, efficient and a good communicator’. Wallace specialises in the resolution of disputes involving wills, trusts and estates. He has particular expertise in dealing with challenges to wills, often on the grounds of lack of testamentary capacity, undue influence or fraud. He also represents individuals and estates in relation to claims under the Inheritance (Provision for Family and Dependents) Act 1975.

    Cembra Money Bank has agreed to acquire cashgate. The purchase price for the acquisition of cashgate and the refinancing of cashgate's loan portfolio is partly backed by a bridge facility and is financed and refinanced by the sale of treasury shares (gross proceeds of CHF 112.8 million) in an accelerated bookbuilding, the placement of CHF 150 million perpetual additional Tier 1 bonds and CHF 250 million net share settled convertible bonds.
  • Bär & Karrer Successfully Represents PNK Group Company in SCAI-Arbitration

    Bär & Karrer successfully represented a company acting under the trademark of PNK Group, a major developer of industrial facilities in Russia, against a Western European concrete plant engineering and manufacturing company in a SCAI-arbitration concerning the delivery of (defective) equipment. After full-fledged proceedings including a hearing with several technical experts, the client was awarded partial rescission of the contract (as requested) with returning of certain defective equipment against refund of its cost, a substantial price reduction with regard to the rest of the equipment, as well as a contractual penalty payment and reimbursement for 75% of all legal costs. Team members were Matthew Reiter and Désirée Schreyer (both arbitration).
