Career

Erik Valgaeren’s practice focuses on IT, internet, e-commerce and electronic communications law, as well as on IP issues relating to the aforementioned subjects. He has a thorough understanding of technical issues relating to communications. His work includes the drafting of contracts, advising on legislation and regulatory aspects and litigation both before national courts and arbitral tribunals. Typical projects include web services, outsourcing, facilities management, system integration, software implementation, data transmission, databases, health IT, privacy, distribution and partnerships. His IP-related activities are mainly driven by the increasing interaction between infrastructure and the content / information communicated thereby.

Erik Valgaeren is a member of both the Brussels Bar and the New York Bar (admitted in 1992).
As an associate with Wilmer Cutler and Pickering in DC, he was a member of the international trade group and advised foreign companies on US trade sanctions law. Erik also had a mandate at the Thomas More Hogeschool Mechelen.

Erik is chief editor of “Computerrecht”, a Belgian-Dutch legal periodical of Kluwer on ICT law (2009). He is member of the FITCE (Federation of International Telecom Engineers), member of the Technology Committee of the International Bar Association (IBA) (member since 2005), Committee's Secretary and Treasurer (2009-2010), Vice-Chair (2011), Committee’s co-chair (2012-2013), chair of the LPD Task Force – Government access to IT systems (2017).

Education

Erik graduated in law from the Katholieke Universiteit Leuven (1990), he holds a Master of Laws (LL.M.) from the University of Chicago School of Law (1991) and a master in Computer Management Courses at the Vrije Universiteit Brussel (1999-2000).

The TMT and IP departments at Stibbe handle a range of contentious and strategic matters in the IT and telecoms sector, and counts Microsoft-Skype, Lycamobile, Verizon and Google among its clients. A team, led by practice head Erik Valgaeren, is representing Anheuser-Busch InBev in a dispute relating to its data centre services outsourcing agreement with CapGemini. The team is regularly instructed in public sector IT projects and assisted Astrid with its procurement strategy for the renewal of the maintenance contract for its core telecoms and dispatching network. Hans Van Bavel is a name to note for cybercrime and compliance matters. Laurens Dauwe is now with Osborne Clarke.

Stibbe's TMT and IP department counts Time Warner, Morris Comics, Belgian National Lottery and Skype among its media and entertainment sector clients. Practice head Erik Valgaeren led a team advising reality television producer Zodiak on several issues, including those relating to the development of a new television program, as well as GDPR compliance, tax and employment advice. In another work highlight, the department acted for a client on IP and regulatory considerations relating to the launch of a digital video streaming platform in Europe. The practice also assists the Flemish government and recently advised on a draft decree relating to social-cultural work for adults. Ignace Vernimme is a key name to note for IP issues. Laurens Dauwe is now with Osborne Clarke.
