Boutique Ada Alegre Consultores has ‘the most specialised environmental practice in the country’, due in no small part to the ‘matchless expertise’ of name partner Ada Alegre. The five-strong team receives a steady stream of environmental instructions relating to the oil and gas, mining, agriculture and infrastructure fields, and represents clients in proceedings in relation to environmental infractions.

Natural resources boutique Delapuente’s name partner Lorenzo de la Puente is a market-leading figure and is widely acclaimed as a ‘pioneer in environmental law’ in Peru. He specialised in the field 20 years ago, and now has an enviable wealth of experience in both public and private institutions. Past high-profile consultancy work has included assisting the Peruvian Ministry for Energy and Mining with environmental assessment regulations for small mining companies; and the World Bank in relation to climate change legislation. Luzmila Zegarra brings her mining-sector expertise to the team.

Miranda & Amado’s first-tier projects expertise, regulatory capability and understanding of administrative proceedings translate into a ‘very strong’ environmental practice that shines in natural resources and energy-related matters. Clients include Engie Energía Perú which the team assists with environmental management instruments, permits, water rights matters and environmental governmental approvals in relation to its execution and operation of several electric power plants and projects. It is also permanent counsel to Repsol Exploración Perú on environmental compliance matters in relation to its Block 57 operations, as well as regarding a number of sanction proceedings initiated by OEFA. Alberto Delgado heads the team, which also includes senior associate Alberto Ventura Rivas and associate Adriana Bendezú.

Rodrigo, Elías & Medrano, Abogados received a boost in 2016 with the arrival of ‘outstanding environmental lawyer’ Jenny Caldas from Muñiz, Ramírez, Pérez-Taiman & Olaya Abogados. The team is well known for the breadth of its practice and draws on its top-tier practices in mining, oil and gas, projects and energy to provide advice on contentious and non-contentious environmental matters. In a high-profile example of its expertise, the team successfully obtained approval of the environmental impact studies concerning Southern Peru Copper Corporation’s $1.2bn Tia Maria mining project and the expansion of its Toquepala project, which both involved administrative procedures and negotiations with local communities. The firm also assisted Luz del Sur with the environmental aspects of the development and construction of a large $500m power project. Luis Carlos Rodrigo Prado and Francisco Tong co-head the team. Of-counsel Úrsula Zavala is highly regarded.

Vito Verna’s practice at CMS Grau leverages off its signature strength in natural resources to field a strong practice in environmental and regulatory matters. The group’s strength lies primarily in safety, health, and environmental assistance to energy and mining companies, but it is also active in the aerospace, chemical, industrial, sanitation, and fishing industries. Clients include Compañía Minera Antamina, Lindley Corporation, BASF The Chemical Company and Hudbay Minerals. Senior associate Paola Carbajal is also recommended.

Estudio Echecopar member firm of Baker & McKenzie International’s team is co-led by natural resources lawyer Valentín Paniagua and public law expert Jorge Danós, and handles a wide range of environmental issues including multi-jurisdictional climate change and carbon trading policies, environmental compliance assessments, administrative and judicial actions, liability claims, and regulatory consultancies. The firm advised Permian Global Advisors on a long-term funding agreement for conservation activities and the implementation of a REDD+ project in San Matias San Carlos forest. It is currently representing Petróleos del Perú in administrative sanction claims brought by public authorities over oil spills in Petroperú’s pipeline. Osterling Abogados’ practice is focused on advising companies on environmental permits for mining exploration activities, and representing clients before the regulatory and environmental authorities. Instructions include due diligence matters, environmental, territorial and regulatory planning of investment projects, and related litigation. A recent highlight included assisting Rio Tinto Mining and Exploration obtaining approval of the environmental certification of its Suyawi mining exploration project. Other clients include Hudbay Perú, Allianz Global Corporate & Specialty, and Helicopteros del Sur. Luis Felipe Huertas del Pino heads the team, which features the highly regarded Miyanou Dufour and associate Juan Pablo Macassi.

Environment law and climate change are core areas of expertise at Rubio Leguía Normand, which has strength across the full array of project development and corporate, financing and investment support matters. The team is led by mining expert Xennia Forno, who recently assisted Hoteles Costa del Sol with an audit of the environmental legal requirements applicable to its hotel located at Lima International Airport. She also advised Natura on the purchase of Verified Emission Reductions credit in the framework of a REDD+ project in the Amazon forest.

Hernández & Cía. Abogados has a broad-ranging environmental practice, with experience in compliance, impact assessments, permitting issues and due diligence processes. Luis Rodríguez-Mariátegui heads the team, and has been advising Procter & Gamble on the environmental aspects of the closure of its detergent production line, which included solid waste disposal matters. Lorena Tanji is also recommended.

The ‘experienced, solid and practical’ team at Lazo, De Romaña & CMB Abogados combines the particular expertise in water resources issues of ‘excellent’ senior associate and practice head Julián Li, with a more general environment capability in other matters provided by ‘environmental pundit’ Jorge Lazo. The team also features the ‘knowledgeable and client-focused’ Juan Manuel Pazos. Lazo and Pazos advised public entity PROINVERSIÓN on the environmental and regulatory aspects of the Hidrovía Amazónica infrastructure project, involving advice on the risk matrix, a consultation procedure with indigenous communities, concession contract negotiations, and the impact of new regulations. On the contentious side, the team defended Refinería La Pampilla in five administrative sanctioning procedures before the Environmental Supervision Authority.

Muñiz, Ramírez, Pérez-Taiman & Olaya Abogados was hit by the departure of former head Jenny Caldas to Rodrigo, Elías & Medrano, Abogados, but moved swiftly to appoint Renato De Vettori to the helm of the firm’s environmental practice. Clients retain their high regard for the practice, noting that ‘it is always one step ahead of their needs’. De Vettori previously served as legal director of energy-related environmental affairs at the Peruvian Ministry of Energy and Mines, and has a wealth of experience in environmental and regulatory matters related to mining, hydrocarbons and electricity projects. Recent clients include Icatom, Monsanto Perú, Transportadora de Gas del Perú, and Sociedad Minera Austria Duvaz.

Estudio Olaechea scores highly with clients for its ‘very good service’, ‘timely responses’ and the ‘impeccable quality of its advice’. The ‘very professional, dedicated and diligent’ José Antonio Honda heads the team, which recently advised Ferrovía Transcontinental Rey Perú-Brasil on all legal aspects (including environmental) of the development of its $10bn rail infrastructure project. It also assists Monsanto Perú with environmental regulations in relation to its agricultural business.

Payet, Rey, Cauvi, Pérez Abogados has a strong focus on social and environmental risks related to financing and capital markets transactions, and specialises in advising investors, private equity funds and lenders on environmental issues in pre-M&A and project financing audits. Senior associate Vanessa Chávarry co-heads the practice with José Cúneo and assists both Banco de Crédito del Perú and Credicorp Capital Financial Services with the environmental clauses in their loan agreements an on-going basis. Other clients include Forsac Perú, Ford Peru, and Gold Fields La Cima.

Philippi Prietocarrizosa Ferrero DU & Uria has experience advising on environmental issues, both contentious and non-contentious, in the energy and mining sectors. Practice head Fabiola Capurro is defending Doe Run Perú in all administrative sanctions proceedings related to environmental matters before Peru’s environmental supervision bodies; and advising BHP Billiton on permits, licences and authorisations required for its mineral exploration projects. Other clients include Grupo PRIMAX, Rio Blanco Copper, and APM Terminals Callao.

Santiváñez Abogados is noted for advising on environmental matters related to transactional operations and some of the largest energy projects in the jurisdiction, such as that of PERU LNG’s liquefaction project – for which the firm advised on all applicable environmental rules and regulations. The team is permanent counsel to Abengoa Transmisión Sur on regulatory and environmental matters; and has also, of late, been representing Compañía Eléctrica El Platanal in administrative disciplinary proceedings over alleged infringement of environmental regulations.
