Cybersecurity & Data Privacy

With the technological evolution set in motion with the advancing “data-driven economy”, the importance of personal data as relevant assets to business has increased substantially, affecting the decision-making process of companies in different market sectors. The relevance of this matter has increased especially with the entry into force of the Brazilian General Law of Protection of Personal Data (LGPD), reinforcing the need to ensure the adequate management of the collected personal data.
Our Cybersecurity and Data Privacy team is therefore an ally in the development of this ecosystem, being responsible for addressing the various demands in connection to data protection matters. With specialized professionals in the matter and frequently in contact with the National Data Protection Authority (ANPD), our team develops and conducts LGPD Conformity Programs, assists in the management of security incidents, as well as in the structuring of training programs on the field. In addition, we have broad experience in conducting Data Privacy audits, drafting and reviewing privacy policies, and drafting contractual relationships in light of the warranties set forth in the data protection legislation. We also have expertise in acting in the civil and criminal spheres with disputes related to potential information security breaches, also implementing urgent judicial measures for the protection of data maliciously disclosed on the internet, as well as in disputes regarding consumer protection agencies involving consumer relations carried out in digital media.
Our professionals have an advantage in the market for providing services of excellence, contributing to the development of our clients’ business allied to the requirements set forth in the applicable regulation. We also have a close interaction with several sector groups of the firm, providing comprehensive and multidisciplinary assistance with any presented cases.

We assist companies from the innovation ecosystem with day-to-day issues, including the drafting/review of corporate actions, partnership agreements, commercial and employment contracts, privacy policies and terms of use, besides trademark registration. We are fully able to work on due diligences for the assessment of potential risks and contingencies, as well as on any possible mitigation measure; and also to provide legal advice on M&A deals, including assistance in negotiating with potential investors and drafting/reviewing the transaction’s documents.
