The Department of State's Visa Bulletin for September includes results from the diversity visa (DV) lottery for fiscal year (FY) 2025 (October 1, 2024, to September 30, 2025). The Kentucky Consular Center in Williamsburg, Kentucky, has registered and notified the approximately 131,060 selectees who are eligible to participate. Entrants registered for the DV-2025 program were selected at random from 19,927,656 qualified entries received. The country with the most registrants selected is Algeria, with 5,526.

The bulletin notes that those selected "will need to act on their immigrant visa applications quickly. Applicants should follow the instructions in their notification letter and must fully complete all required steps." Many more were selected than can receive visas (55,000) to account for factors such as some selectees not completing their cases or being found ineligible for a visa.

DHS Proposes $70,000 And $30,000 Fees For F-1 Optional Practical Training

The Department of Homeland Security has proposed a controversial new rule requiring SEVP-certified schools to pay substantial fees—$70,000 for a student's first Optional Practical Training recommendation and $30,000 for each subsequent OPT application, including STEM extensions. With only a 30-day comment period and potential annual costs reaching up to $16.5 billion across nearly 2,500 affected institutions, the proposed regulation is expected to face significant legal challenges if finalized.

Duration Of Status Rule Postponed Before It Takes Effect

A federal court in Massachusetts has postponed the Department of Homeland Security rule that would have ended 'duration of status' admissions for F, J, and I nonimmigrants, originally scheduled to take effect September 15, 2026. This preliminary injunction affects students, exchange visitors, foreign media representatives, and their sponsoring institutions, though the postponement is not a final invalidation of the rule and litigation continues.

Proposed Rule Would Eliminate The 60-Day Grace Period For Many Temporary Work Visa Categories

The Department of Homeland Security has proposed eliminating the 60-day grace period that currently allows workers in H-1B, L-1, O-1, E, and TN visa categories to remain in the United States after their employment ends. If finalized, this rule would require immediate departure or status change the day after employment termination, fundamentally altering how employers and foreign workers manage job transitions and creating significant compliance challenges for both parties.
