The Employment Equality (Age) Regulations 2006 have now been published in their final form and are due to come into force on 1 October this year.

The Regulations impose obligations on employers, providers of vocational training and qualifications bodies, trade organisations, further education establishments and many others. They will cover recruitment, terms and conditions of employment, promotions, transfers, dismissals, training and retirement.

Discrimination on the grounds of age will form the basis of a new raft of possible claims to employment tribunals, with the potential for unlimited compensation that includes awards in respect of injury to feelings. Direct and indirect discrimination and harassment and victimisation on the grounds of age will be actionable for the young, old and even middle aged.
