Ministry of Road Transport and Highways extends relief measures to contractors on account of COVID

The Ministry of Road Transport and Highways (“MoRTH”) issued a circular dated December 1, 2022 extending certain relief measures, available to the contractors/developers of HAM/EPC projects in the road sector, until March 31, 2023.

The relief measures which have been made available to the contractors/ developers until March 31, 2023 include:

  1. The conditions specified in Schedule G/H of the relevant HAM/ EPC contracts, which specifies the release of portion of contract price for different stages of construction, will continue to remain relaxed and payments will be released to the contractor/ developer on a monthly basis for the work completed in the relevant month as per specifications.

On 23 July 2026, the Department for Promotion of Industry and Internal Trade (DPIIT), Ministry of Commerce and Industry, issued Press Note No. 3 (2026 Series) a document whose brevity belies the significance of what it achieves. In a little over two pages, the Government of India has quietly dismantled one of the most longstanding restrictions in its FDI policy architecture: the blanket prohibition on foreign investment in inventory-based e-commerce. The caveat, however, is precise and deliberate: the permission is confined exclusively to exports of goods manufactured or produced in India.

The Supreme Court Of India Clarifies: Order II Rule 2 Of The Code Of Civil Procedure, 1908 Cannot Be A Ground For Rejection Of Plaint Under Order VII Rule 11(D) Of The Code Of Civil Procedure, 1908

A two judge bench of the Hon’ble Supreme Court of India (“Supreme Court”) in S. Valliammai and Ors. vs. S. Ramanathan and Anr. recently held that Order II Rule 2, Code of Civil Procedure, 1908 (“CPC”) cannot constitute a ground for rejection of plaint under Order VII Rule 11(d) of the CPC. The Supreme Court drew a critical distinction between the two provisions clarifying that while Order II Rule 2 curtails the right to sue for certain claims or reliefs, but it does not bar filing of a suit under Order VII Rule 11(d) of the CPC.

Supreme Court Clarifies That Compromise Decrees Asserting Pre-existing Rights Are Not Subject To Registration Or Payment Of Stamp Duty

In the recent case of Mukesh vs. The State of Madhya Pradesh and Anr., the Hon'ble Supreme Court of India adjudicated on the issue of whether compromise decrees that assert pre-existing rights necessitate registration under the Registration Act, 1908 and are subject to stamp duty under the Indian Stamp Act of 1899.
