中国では、2020年10月17日に第四次改正専利法が可決され、2021年6月1日より施行されることになった。 改正専利法の施行に合わせて、2020年11月27日に「専利法実施細則改正案（意見募集稿）」が公布され、2021年1月11日までに意見募集が行われていたが、 2023年12月21日にようやく最終改正版が公表され、2024年1月20日から施行されることが決まった。
また、これとともに、CNIPAより改正された「専利審査指南」と、「改正後の専利法及びその実施細則に係る審査業務処理に関する経過措置（第559号）」も公表され、2024 年 1 月 20 日から施行されるようになった。
